Gaming Highlight Clipper AI (the "Software", also marketed as "Gaming Clipper AI") is a software product developed and operated by Tradefleet LLC, a limited liability company registered in the State of Wyoming, United States, with its principal business location in Cheyenne, Wyoming 82001 ("we", "us", "Tradefleet"). Any reference to "GamingClipperAI" in these Terms, in the Software, or on this website refers to a product line of Tradefleet LLC. All contracts of sale and licensing of the Software are entered into with Tradefleet LLC as the merchant of record.
These Terms of Service (the "Terms") govern your access to and use of the gamingclipperai.com website (the "Site") and the Software. By visiting the Site, downloading, installing, activating, or otherwise using the Software, or purchasing a license, you agree to be bound by these Terms. If you do not agree, do not use the Site or the Software.
The Software is also governed by its bundled End User License Agreement (the "EULA"), which is presented during installation and viewable at any time from the Software's About tab. In the event of any conflict between the EULA and these Terms, the EULA prevails for matters strictly concerning the installed Software, and these Terms prevail for matters concerning the Site, payment, and your relationship with Tradefleet LLC.
Upon a valid one-time purchase, Tradefleet LLC grants you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use the Software on any Windows computer that you personally own or control. Your license key is derived deterministically from the email address you purchased with; entering the same email plus key on a different machine activates the Software there without any online check and without expiry.
A free 7-day trial is available to users who have not yet purchased a license. Trial exports carry a small "Made with GamingClipperAI" watermark; all other features are unlocked. The trial period is time-limited and non-renewable per install.
You may use the Software only for lawful purposes. You may not:
The Software is sold as a one-time purchase of a lifetime license at the price displayed on the Site at the time of purchase (currently USD $49). All payments are processed by Stripe, Inc. on behalf of Tradefleet LLC. Your card statement will show a descriptor identifying Tradefleet LLC (or an abbreviation of it as permitted by the payment network).
All sales are final. Please see our Refund Policy for details. A free 7-day trial is available so that you can evaluate every feature of the Software before purchasing.
Your license entitles you to all v1.x updates at no additional cost. Future major-version releases (v2.0.0 and later) may require a new license; if so, existing v1.x license holders will be offered an upgrade path.
The Software is designed to run fully on your own computer after installation. We do not upload, store, transmit, or otherwise access your video, audio, or gameplay data at any time. For a complete description of what information we do and do not collect, see our Privacy Policy.
THE SITE AND THE SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRADEFLEET LLC DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL MEET YOUR REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRADEFLEET LLC, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE SOFTWARE, WHETHER OR NOT TRADEFLEET LLC HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRADEFLEET LLC FOR THE LICENSE.
These Terms remain in effect until terminated. They terminate automatically if you breach any term above. Upon termination you must delete all copies of the Software. Sections 5, 8, 9, 11 and 12 survive termination.
These Terms, and any dispute arising out of or in connection with them or your use of the Software, are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles. The state and federal courts located in Laramie County, Wyoming shall have exclusive jurisdiction over any such dispute, subject only to any mandatory consumer-protection rights that cannot be waived under the law of your country of residence.
We may update these Terms from time to time. Material changes will be reflected by an updated "Effective date" above and announced via the Site. Your continued use of the Site or the Software after the updated Terms become effective constitutes acceptance of the updated Terms.
